Rule 13-302 - AFFIDAVIT OF RECEIVER, ASSIGNEE, AND PROFESSIONAL(a) Required Disclosure by Affidavit of Receiver or Assignee A receiver or assignee shall file an affidavit containing all of the information that would demonstrate eligibility under Code, Commercial Law Article, § 24-203(b).(b) Required Disclosure by Affidavit of Other Professional Each attorney, accountant, appraiser, auctioneer, broker, or other professional to be employed by the assignee or receiver shall file an affidavit containing all of the information that would demonstrate eligibility under Code, Commercial Law Article, § 24-303.(c) When Filed The affidavit shall be filed:
(1) by an assignee, with the petition;(2) by a receiver, with the petition or motion seeking appointment of the receiver;(3) by an attorney, accountant, appraiser, auctioneer, broker, or other professional, with the motion requesting authority to employ the person.(d) Supplemental Disclosure A person who has filed an affidavit under this Rule and who learns that the information in the affidavit is inaccurate or incomplete shall promptly file a supplemental affidavit.
(e) Penalty for Failure to Disclose Required Information In addition to any other remedies provided by law, the court, pursuant to Rule 13-701, may remove any person who fails to disclose any information required to be disclosed by this Rule and may take any action permitted or required by Rule 13-703.
