Rule 1 - Scope of Authority

The disciplinary authority of the commission extends to every judge and judicial officer subject to article 6.1 of the constitution and the code.

RULES GOVERNING

<Proceedings commenced prior to the January 1, 2002 effective date of these new rules shall continue to be governed by the rules effective prior to the effective date until the closure of the matter.>

HISTORICAL NOTES

The former rule, adopted May 24, 1990, effective July 1, 1990, amended March 27, 1995, effective June 1, 1995, was abrogated by Order dated October 11, 2001, effective December 31, 2001. Because the former rule has continuing effect for actions begun prior to the date of repeal, the text of the rule is set out below.

"Rule 1. Organization

"(a) Membership. The commission shall be made up of eleven members as provided in the constitution.

"(b) Officers. The members of the commission shall elect a chairman, a vice-chairman, and a secretary, each of whom may serve successive two-year terms. If an officer resigns or ceases to be a member of the commission, the commission shall elect another member to fill the remaining term of the vacated office.

"(c) Duties of Officers. The chairman shall perform the duties normally associated with the office and shall preside over all general meetings of the commission, but shall designate a judicial member of the commission to preside at formal proceedings instituted under these rules. The vice-chairman shall act as chairman in the absence of the chairman, and in the absence of both, the members present at the meeting may select an acting chairman. The secretary, assisted by the executive director, shall keep the minutes of commission meetings and record the minutes in the permanent records of the commission. The chairman may appoint an acting secretary in the absence or inability of the secretary to perform these duties.

"(d) Quorum. Except as otherwise provided in these rules, six members of the commission shall constitute a quorum for the transaction of the commission's duties; but recommendations to the supreme court shall require a majority vote of the entire membership of the commission. The majority need not have participated in the entire formal proceedings.

"(e) Meetings. The chairman or any three members may call a meeting of the commission and designate when and where the meeting shall be held. The chairman or executive director shall notify each member of the time and place of any meeting. Commission members may communicate with each other by telephone or other means as to any preliminary matter, but a formal hearing shall be attended by not less than six members of the commission.

"(f) Expenses. Commission members shall receive no compensation for their services but may be reimbursed for their travel and other expenses incidental to the performance of their duties."
