Rule 608 - Dismissal and Other Action by the Court of Appeals; No Motion for Reconsideration; Motion for Publication(a) Dismissal. Before or after briefing is completed, the appellate court may dismiss an appeal: (1) if it is withdrawn by the appellant, or(2) on its own initiative or an appellee's motion, for any legal cause, including lack of jurisdiction or lack of prosecution, unless the appellant shows good cause why the appeal should not be dismissed.(b) Action by the Appellate Court. The appellate court may:(1) affirm the order of the juvenile court;(2) vacate or reverse the order and remand for appropriate action by the juvenile court;(3) take the matter under advisement and order the filing of additional matters in the appellate court;(4) take other actions the court deems just and proper under the circumstances, including suspending the appeal and revesting jurisdiction in the juvenile court for further proceedings in that court.(c) No Motion for Reconsideration. A party may not file a motion for reconsideration of a final order, decision, or opinion of the Court of Appeals.(d) Motion for Publication or De-publication. A party may file a motion for publication or de-publication no later than 15 days after the filing of the decision and before a petition for review to the Supreme Court is filed.Adopted Dec. 8, 2021, effective 7/1/2022.
