Rule 404 - Appointment, Appearance, and Withdrawal of Counsel(a) Appointment. The court may appoint counsel for a person who is entitled to counsel and determined to be indigent as provided by law, these rules, or ICWA. To determine whether a person is indigent, the court may require the person to provide proof of financial resources by filing a financial questionnaire provided by the court. The court may question the person under oath. If the court determines the person is not indigent, it may order the person to pay a reasonable portion of the cost of counsel or deny the request to appoint counsel. If the court enters an order appointing or denying counsel, it must provide a copy of the order or minute entry to the parties.(b)Appearance. Counsel may enter an appearance by: (1) personally appearing in open court and advising the court that counsel is representing a party, or(2) filing a written notice of appearance and providing copies to the assigned judge and all parties.(c) Withdrawal of Counsel. Unless otherwise authorized by the court, a request to withdraw as counsel must be in writing, and a copy of the request must be provided to the parties.Adopted Dec. 8, 2021, effective 7/1/2022.
