Rule 21 - Alternative Dispute Resolution(a) Generally. On a party's motion or on its own, the court may order the parties to participate in one or more alternative dispute resolution processes, such as a settlement conference or, if the parties agree, private mediation or a form of arbitration.(b) Duty to Confer and Participate. The parties must make a good faith effort to agree on an alternative dispute resolution process. If they participate in an alternative dispute resolution process, they must do so in good faith.(c) Compulsory Arbitration Not Required. Unless the parties agree otherwise, they are not subject to compulsory arbitration under Civil Rules 72 through 77.Amended Aug. 29, 2019, effective 1/1/2020.
