Notice of disqualification against an industrial appeals judge in an appeal will disqualify a judge from hearing or deciding a matter, except only one notice may be filed by a party in an appeal and such notice must be filed:
(1) Within thirty days of receipt of the notice of assignment of the appeal to the industrial appeals judge or prior to the assigned industrial appeals judge holding any proceeding in the appeal, whichever occurs sooner; or(2) Within five business days of notification that the appeal has been assigned to a new industrial appeals judge for the purpose of writing a proposed decision and order.Wash.
