Section 110-03-0430 - Burden of proof and standard of proof(1) The party who has the burden of proof is the party who has the responsibility to provide evidence to persuade the ALJ that a position is correct under the standard of proof required.(2) Standard of proof refers to the amount of evidence needed to prove a party's position. Unless a rule or the law states otherwise, the standard of proof in a hearing is a preponderance of the evidence. This standard means that it is more likely than not that something happened or exists.(3) The ALJ decides if a party has met the burden and standard of proof.Wash. Admin. Code § 110-03-0430
