Section R590-146-20 - Marketing Standards(1) An issuer, directly or through its producers, shall:(a) establish marketing procedures to assure that any comparison of policies by its producers will be fair and accurate;(b) establish marketing procedures to assure excessive insurance is not sold or issued;(c) display prominently by type, in bold font, stamp, or other appropriate means on the first page of the policy: "Notice to buyer: This policy may not cover all of your medical expenses.";(d) inquire and otherwise make a reasonable effort to identify whether an applicant already has accident and health insurance and the types and amounts of any such insurance; and(e) establish auditable procedures for verifying compliance.(2) In addition to the practices prohibited in Title 31A, Chapter 23a, Part 4, Marketing Practices, the following acts and practices are prohibited:(a) cold lead advertising;(b) high pressure tactics; or(3) The terms "Medicare Supplement," "Medigap," "Medicare wrap-around," or similar words may not be used unless the policy is issued in compliance with this rule.Utah Admin.
