Section R477-8-16 - Fitness for Duty EvaluationsManagement may require a fitness for duty medical evaluation under any of the following circumstances:
(1) return to work from injury or illness except as prohibited by federal law;(2) when management determines that there is a direct threat to the health or safety of self or others;(3) in conjunction with corrective action, performance or conduct issues, or discipline; or(4) when a fitness for duty evaluation is a bona fide occupational qualification for selection, retention, or promotion.Utah Admin.
