Section R277-445-1 - Authority and Purpose(1) This rule is authorized by: (a) Article X, Section 3 of the Utah Constitution, which vests general control and supervision over public education in the Board;(b) Subsection 53F-2-304(3), which requires the Board to adopt rules that: (i) govern the approval of necessarily existent small schools consistent with state law; and(ii) ensure that districts are not building secondary schools in close proximity to one another where economy and efficiency would be better served by one school meeting the needs of secondary students in a designated geographical area;(c) Subsection 53F-2-304(7), which requires the Board to define isolating conditions, which may qualify a non-NESS school for additional funding; and(d) Subsection 53E-3-401(4), which allows the Board to make rules to execute the Board's duties and responsibilities under the Utah Constitution and state law.(2)(a) The purpose of this rule is to specify the standards for schools and districts to received funding under the NESS program.Utah Admin.
