Section R151-4-305 - Ruling on a Motion(1) The presiding officer shall verbally rule on a motion at the conclusion of oral argument when possible.(2) When a presiding officer verbally rules on a motion, the presiding officer shall issue a written ruling within 30 calendar days after the day the presiding officer makes the verbal ruling.(3) If the presiding officer does not verbally rule on a motion at the conclusion of oral argument, the presiding officer shall issue a written ruling on the motion no more than 30 calendar days after:(b) if there is no oral argument, the final submission on the motion as outlined in Subsection R151-4-304(2).(4) The failure of the presiding officer to comply with the requirements of Section R151-4-305:(a) is not a basis for dismissal of the matter; and(b) is not an automatic denial or grant of the motion.Utah Admin.
