Section 13.162 - Laboratory Retesting for Possible Tampering - Security Control(a) Suspicious incident. Unless there is an obvious, reasonable explanation for the event in question, each witness to a destruction under this subchapter is responsible for returning an item to a laboratory for testing to detect a discrepancy, loss, theft, or other potential diversion if: (1) the count or weight of the item is substantially incorrect;(2) a package has been opened; or(3) there is another suspicious incident or probable breach of security.(b) Laboratory options. If an individual returns an item to a laboratory for testing under this section, the laboratory may conduct an analysis sufficient to detect discrepancy, loss, theft, or other potential diversion or to resolve the particular suspicion surrounding the incident.37 Tex.
