(a) Records. Each LP-gas licensee, registered manufacturer, or other registrant shall retain: (1) records of pressure tests and leakage tests for at least five years;(2) a copy of all documentation submitted for an exception to an LP-gas rule pursuant to § RSA 9.27 of this title (relating to Application for an Exception to a Safety Rule), including the AFS director's memorandum granting the exception, for as long as the exception is in use; and(3) a copy of all customer records for at least five years.(b) Periodic inspection. AFS shall formulate a plan or program for periodic evaluation or inspection of records and facilities owned, operated, or serviced by LP-gas licenses, registered manufacturers, or other registrants for the purpose of verifying compliance with this chapter.(c) Scope of inspection. During normal business hours, an authorized representative of the Commission may, at any reasonable time, inspect the files, records, reports, documents, equipment, transports, and facilities of an LP-gas licensee for the purpose of verifying compliance with this chapter.(d) Licensee, registered manufacturer, and other registrant obligations. (1) A registrant, officer, employee, or representative of an LP-gas licensee shall cooperate with the Commission and its authorized representatives in the administration and enforcement of the provisions in this chapter, in the determination of compliance with the provisions of this chapter, and in the investigation of violations, complaints alleging violations, and accidents or incidents involving LP-gas.(2) A registrant, officer, employee, or representative of an LP-gas licensee shall make readily available all files, records, reports, documents and information, and shall make readily accessible all company equipment, property, and facilities as the Commission or its authorized representative may reasonably require in the administration and enforcement of this chapter, and in the investigation of violations, complaints alleging violations, and accidents or incidents involving LP-gas.(3) Upon request by an authorized representative of the Commission, an LP-gas licensee's officer, employee, or representative, or a registrant shall provide copies of records, files, reports, documents, and information for administration and enforcement of this chapter.16 Tex.
