Section 391.309 - Contract Awards During Protest

A contract will not be awarded that is subject to a properly filed protest until HHSC provides a final written disposition of the protest in accordance with § 391.307 of this subchapter (relating to Review and Disposition of Protests). The HHSC Executive Commissioner may waive this requirement if the HHSC Executive Commissioner determines that HHSC must award a contract, without delay, to protect the best interests of the state.
