Section 1720-02-03-.06 - APPEALS(1) Persons who want to appeal a parking citation must submit the appeal online at the UTC Department of Parking Services website (http://www.utc.edu/auxiliary-services/parking/) or in writing at the UTC Bursar's Office within fourteen (14) calendar days of the issuance of the citation. Persons who fail to appeal a parking citation within fourteen (14) calendar days of the citation's issuance forfeit their right to appeal the citation.(2) An appeal of a parking citation issued to a vehicle may be made either by the registrant (if a registered vehicle) or the owner/operator (if an unregistered vehicle).(3) The UTC Student Parking Appeals Board will review appeals of parking citations issued to UTC students. The members of the UTC Student Parking Appeals Board will be appointed in accordance with Rule 1720-02-05-.14.(4) The UTC Student Parking Appeals Board will set a hearing on each student appeal and will provide written notice to the student of the hearing date. Students may attend their appeal hearing and present evidence in support of their appeal. Students are not required to attend their appeal hearing, and a student may request that the Board consider the appeal based on the student's written appeal submissions. If a student fails to appear without advance notice to the Board, the Board will consider the appeal in the student's absence. All decisions of the Board are final and will be binding regardless of whether the student attended the hearing. The Board will provide written notice of its decision to the student.(5) The UTC Nonstudent Parking Appeals Board will adjudicate the appeals of parking citations issued to persons who are not UTC students. The members of the UTC Nonstudent Parking Appeals Board will be appointed by the UTC Chief Business Officer or his or her designee.(6) The UTC Nonstudent Parking Appeals Board will set a hearing on each nonstudent appeal and will provide written notice to the appellant of the hearing date. Appellants may attend their appeal hearing and present evidence in support of their appeal. Appellants are not required to attend their appeal hearing, and an appellant may request that the board consider the appeal based on the appellant's written appeal submissions. If an appellant fails to appear without advance notice to the board, the board will consider the appeal in the appellant's absence.
