Section 1350-05-.14 - EXECUTIVE DIRECTOR OF THE SPORTS WAGERING COUNCIL

The Executive Director shall have the following duties with regard to the Fantasy Sports Act, in addition to the duties set forth in the Rules related to the Sports Gaming Act.

(1) To advise the Council of best practices with respect to the Council's regulatory responsibilities pursuant to the Fantasy Sports Act.
(2) To provide administrative and technical assistance to the Council and to administer all programs and functions that have been required of the Council or as set forth in the Rules of the Council, including this Chapter 1350-05.
(3) To send and receive notices required to be made to the Council or communications made on behalf of the Council, which may be sent to or issued from the Executive Director as agent of the Council.
(4) To approve, condition, or deny applications for initial licensure and renewal of licensure submitted by Fantasy sports operators.
(5) To review, approve or deny the arrangements proposed by Fantasy sports operators pursuant to Rule 1350-05-.08(2) for reserves, special purpose segregated accounts, and qualified escrow accounts.
(6) To review independent audits submitted by Fantasy sports operators and determine whether such audits demonstrate a Fantasy sports operator's compliance with the Fantasy Sports Act and this Chapter 1350-05.
(7) To review, approve or deny entities seeking to provide compliance audit services pursuant to Rule 1350-05-.11(2)(b).
(8) To provide information to the Department of Revenue to assist in the administration and collection of taxes applicable to Fantasy sports operators.
(9) To address player complaints or to assign the investigation of player complaints to a staff designee.
(10) To investigate suspected or reported violations of the Fantasy Sports Act and this Chapter 1350-05, to make evaluations as necessary to determine if Fantasy sports operators are complying with the Fantasy Sports Act and this Chapter 1350-05, and to issue subpoenas to compel the attendance of witnesses and the production or relevant books, accounts, records, and documents on behalf of the Council. The Executive Director shall recommend appropriate fines or civil penalties to the Council, or may issue appropriate fines or civil penalties on behalf of the Council upon written delegation of authority by the Chairman of the Council. The Executive Director may refer suspected and reported violations of the Fantasy Sports Act, or other state or federal laws, to law enforcement, as appropriate.
(11) To carry out any delegation of authority, as may be received in writing from the Chairman of the Council, from time to time, as exigent circumstances may require.
(12) To carry out any other duties as prescribed or instructed by the Council.
