Section 0620-04-02-.01 - SCOPE
(1) Subject to any superseding federal or state law, these rules shall govern contested case proceedings before the Inspector General that are commenced pursuant to Tenn. Code Ann. §§ 71-5-2501et seq., §§ 71-5-2601et seq. or any other statute or rule wherein the Office of Inspector General is authorized to initiate administrative proceedings pursuant to the Uniform Administrative Procedures Act, as codified at Title 4, Chapter 5, and will be relied upon by administrative judges in all contested cases utilizing administrative judges from the Administrative Procedures Division of the Office of the Secretary of State (whether sitting alone or with the Inspector General).
(2) In any situation that arises that is not specifically addressed by these rules, reference shall be made to the Tennessee Rules of Civil Procedure for guidance as to the proper procedure to follow, as appropriate, and to whatever extent will best serve the interests of justice and the speedy and inexpensive determination of the matter at hand.
