Section 0465-03-.10 - REQUESTS FOR HEARINGS CHALLENGING REFERRALS FOR PLACEMENT ON THE ABUSE REGISTRY AND/OR SUBSTANTIATIONS(1) A person who has received a notice of the type specified in Rule 0465-03-01-.07(3) may: (a) Request a hearing challenging only the referral for placement on the Abuse Registry, in which case the substantiation is not at issue, and the person's name will be placed on the SIRI database for the underlying substantiation(s); or(b) Request a hearing challenging both the referral for placement on the Abuse Registry and the substantiation(s) on which the referral was based.(2) A person who elects to take no action, or who fails to respond timely to the notice, waives all appeal rights. The person's name will be placed on the Abuse Registry as well as on the SIRI database for the underlying substantiation(s).Tenn. Comp. R. & Regs. 0465-03-.10
