Section 61-107.19.V.E.258.50 - Applicabilitya. The requirements in this part apply to all Class Three landfills, except as provided in paragraph b. below.b. Groundwater monitoring requirements in Sections258.51. through 258.55. of this Part may be modified by the Department for a Class Three landfill if the permittee can demonstrate that there is no potential for migration of hazardous constituents from the Class Three landfill to the uppermost aquifer during the active life of the landfill and the post-closure care period. This demonstration shall be certified by a qualified professional and approved by the Department, and shall be based upon: (1) Site-specific field collected measurements, sampling, and analysis of physical, chemical, and biological processes affecting contaminant fate and transport; and,(2) Contaminant fate and transport predictions that maximize contaminant migration and consider impacts on human health and environment.c. Class Three landfills shall be in compliance with the groundwater monitoring requirements specified in Sections258.51.-258.55. before waste can be placed in the landfill.d. Once established at a Class Three landfill, groundwater monitoring shall be conducted throughout the active life and post-closure care period of the landfill as specified in Section258.61.e. For the purposes of this Subpart, a qualified professional shall certify all submittals.f. The Department may establish alternative schedules for demonstrating compliance with the various sections of this Subpart on a case-by-case basis, provided sufficient technical rationale is provided to the Department to justify the alternate compliance schedule.S.C.
