Section 61-107.14.H - Disciplinary Sanctions Allowable and Procedures for Disciplinary Action1. Disciplinary action shall be based on the severity of the violation incurred as determined by the Department. Action shall consist of either: a. Probation under specified conditions relevant to the specific grounds for disciplinary action. Additional education or training, or reexamination may be required as a condition of probation; or,b. Revocation of an operator's certification for a specified timeframe as determined by the Department.2. The following procedure shall be followed when disciplinary action is initiated: a. A Department written notice shall be given to an operator against whom disciplinary action is being taken; and,b. Within fifteen (15) days from receipt of written notification of disciplinary action by the Department, the operator may appeal it as a contested case pursuant to R.61-72 and the Administrative Procedures Act.S.C.
