Section 38-400 - Authorization of Rules1. These rules and regulations are promulgated pursuant to the authority vested in the Department by the General Assembly by its enactments contained in Articles 1 to 11 of Chapter 23 of Title 58 of the Code of Laws of South Carolina, 1976, effective July 1, 1976. All previous rules, regulations, and standards are hereby revoked, annulled and superseded.2. The adoption of these rules shall in no way preclude the Department from altering, amending, or revoking them in whole or in part, or from requiring any other or additional service, equipment, facility or standard, either upon complaint or its own motion, or upon the application of any motor carrier. Moreover, these rules shall not relieve in any way either the Department or the motor carriers of any duties under the laws of this State.3. These rules and regulations are consistent with Section 601, Pre-emption of Intrastate Transportation of Property, of the Federal Aviation Administration Authorization Act of 1994, enacted on August 23, 1994.Added by State Register Volume 22, Issue No. 3, eff March 27, 1998.
