Section 2390.174 - Human rights team(a) If a restrictive procedure is used, the facility shall use a human rights team. The facility may use a county mental health and intellectual disability program human rights team that meets the requirements of this section.(b) The human rights team shall include a professional who has a recognized degree, certification or license relating to behavioral support, who did not develop the behavior support component of the individual plan.(c) The human rights team shall include a majority of persons who do not provide direct services to the client.(d) A record of the human rights team meetings shall be kept.The provisions of this § 2390.174 adopted October 4, 2019, effective in 120 days, 49 Pa.B. 5777.The provisions of this § 2390.174 issued under sections 201(2), 403(b), 403.1(a) and (b), 911 and 1021 of the Human Services Code (62 P.S. §§ 201(2), 403(b), 403.1(a) and (b), 911 and 1021); and section 201(2) of the Mental Health and Intellectual Disability Act of 1966 (50 P.S. § 4201(2)).
