Section 581-022-2263 - Physical Education Requirements
(1) For purposes of this section, "district" means a school district, education service district, or public charter school.
(2)
(a) Every public school student in kindergarten through grade five, and every public school student in grade six at a school that teachers kindergarten through grade six, shall participate in physical education for the entire school year for at least 150 minutes during each school week, or at least 120 minutes during each school week if the school on average holds classes four days a week over the course of the school year.
(b) Except as provided by paragraph (a) of this subsection, every public school student in grades six through eight shall participate in physical education for at least an average of 150 minutes during each school week, as calculated over the duration of a school year, or at least an average of 120 minutes during each school week, as calculated over the duration of a school year, if the school on average holds classes four days a week over the course of the school year.
(c) Notwithstanding the time requirements of paragraphs (a) and (b) of this subsection, districts may reduce physical education minutes by a percentage that correlates to the percentage of minutes that the school did not provide instruction during school weeks when there were:
(A) scheduled school closures, including closures for holidays, inservice days and days scheduled for parent-teacher conferences;
(B) unscheduled school closures, including closures for inclement weather and emergencies;
(C) out-of-school activities that occur during usual school hours, including field trips and outdoor school programs.
(d) Notwithstanding the time requirements of paragraphs (a) and (b) of this subsection, if a district receives a waiver pursuant to OAR 581-022-2320 of the requirement to provide a minimum of 900 hours of instructional time annually for kindergarten through grade eight, the time requirements of paragraphs (a) and (b) of this subsection may be reduced by the percentage of the time requirements specified in paragraphs (a) and (b) of this subsection that correlates to the percentage of instructional time for which the district receives the waiver.
(3) Districts must comply with the requirements of ORS 329.496.
