Section 213-090-0030 - Definitions

As used in OAR 213-090-0010 to 213-090-0090, unless the context requires otherwise:

(1) "Applicant" means cities and counties, and community-based organizations, that submit an application to the Commission for a grant under the Organized Retail Theft Grant Program, and the Oregon State Police.
(2) "Commission" means the Oregon Criminal Justice Commission.
(3) "Community-based organization" means a non-profit organization actively registered to do business in the State of Oregon, based in the community, independent from any unit of local government, and has and discloses to the state:
(a) A current determination letter from the Internal Revenue Service acknowledging tax exempt status for the organization under section 501(c) of the Internal Revenue Code; or
(b) A written fiscal sponsorship agreement with another non-profit organization actively registered to do business in the State of Oregon and that has received a determination letter from the Internal Revenue Service acknowledging tax exempt status under section 501(c)(3) of the Internal Revenue Code, and for which the organization providing fiscal sponsorship agrees to provide its tax-exemption and associated benefits to the community-based organization.
(4) "Grantee acceptance period" means the period of time commencing when an applicant receives notice, in writing, from the Commission, that the Commission has decided to award the applicant grant funds, and concluding when an applicant has returned an executed grant agreement to the Commission.
(5) "Organized retail theft" has the meaning set forth in ORS 164.098.
