Section 612:10-11-2 - Basic eligibility requirements(a) The basic criteria for eligibility for OB services are: (1) the consumer's primary disability is defined as legal blindness; (A) Legal blindness is defined as a Visual Acuity of 20/200 or less in the better eye with best correction, or a visual field of 20 degrees or less. Best correction means the best visual acuity that can be obtained with normal prescription lenses. If there is a difference in near and distance acuity, the worse acuity is used for determination of eligibility. (B) Documentation of legal blindness should be obtained from an eye care physician. If only a general medical report is available stating legal blindness or if documentation is unobtainable, a functional assessment consisting of a detailed explanation of how the consumer functions with distance and near acuity will be provided. (2) the age of the individual is 55 years or older; (3) there is a reasonable expectation that OB services will significantly assist the individual to improve his/her ability to function independently or improve his/her quality of life; and (4) the individual does not meet the eligibility criteria to participate in the vocational rehabilitation program. (b) The guidelines for application for OB services are the same as guidelines for the application for vocational rehabilitation services, with the addition of information to be supplied indicating the age of the applicant. (c) Eligibility must be determined within 60 days of the date the application for services is submitted. Okla. Admin. Code § 612:10-11-2
