Section 455:10-15-3 - Reasonable attorney feesReasonable attorney fees shall be determined primarily though the analysis of the number of hours devoted to the appeal multiplied by a reasonable hourly billing rate. Reasonable attorney fees may be determined by looking at fees awarded the attorney in the past.
(1) The prevailing community rate is considered a reasonable hourly rate.(2) The fee agreement between an attorney and a party to the appeal or any organization, union or association representing a party, establishes a presumption that the amount agreed upon is the maximum reasonable amount.(3) The actual rate of pay for a state attorney representing a party shall be a reasonable rate.Okla.
