Section 75-09.1-10-13 - Opioid treatment program closures

If an opioid treatment program closes involuntarily or voluntarily, the opioid treatment program shall:

1. Provide the division with a plan detailing procedures to ensure continuity of care for patients. The plan must include steps for the orderly transfer of patients, records, and assets to other programs or practitioners to:
a. Assure appropriate referral of patients to avoid disruption in patient care;
b. Preserve the con.dentiality of patient records; and 16
c. Ensure appropriate access to financial records and accounts.
2. The opioid treatment program shall notify the division of the anticipated closure at least ninety days prior to the closure, and identify the rationale for closure and the efforts to establish continuity of care for the patients. An opioid treatment program experiencing dif.culties in maintaining its operations shall exercise due diligence to ensure patients have access to reasonable care upon the opioid treatment program's closure.
