Section 75-02-01.2-13 - Residence1. There is no durational state residence required for eligibility for benefits.2. No individual who is otherwise eligible may be denied assistance under the program if the individual resides in the state.3. A resident of the state is one who:a. Is living in the state voluntarily with the intention of making the individual's home there; orb. At the time of application, is living in the state and is not receiving temporary assistance for needy families from another state.4. For purposes of establishing the temporary assistance for needy families filing unit, a child is a resident of the state in which the child is living other than for a temporary basis. For all other purposes of this chapter, a child is a resident of the state in which the child is living.5. Residence may not depend upon the reason for which the individual entered the state, except insofar as it may bear upon whether the individual is there voluntarily.6.
