Section 38-01-01-01 - Organization of North Dakota highway patrol1.History. The 1935 legislative assembly passed a law creating the North Dakota highway patrol, codified as North Dakota Century Code chapter 39-03. This chapter required the highway commissioner to appoint a state highway patrol superintendent. In 1951, the legislative assembly removed the highway patrol from the highway department and placed it under the direct control of the governor. The governor now appoints the superintendent and the superintendent appoints personnel to the patrol. 2.Function. The highway patrol is responsible for enforcing the provisions of the laws of the state relating to the protection and use of the highways in the state, the operation of motor and other vehicles upon such highways; a public education and information program to reduce accidents and encourage safe driving practices; security and protection for the governor, the governor's immediate family, and other officers next in order of succession to the office of governor; police powers on state property; and the operation, maintenance, and administration of the law enforcement training academy. 3.Inquiries.
