Section 06R .0802 - PROVISIONAL CERTIFICATE(a) A provisional renewal certificate shall be issued by the Division of Aging and Adult Services when: (1) The certification renewal process identifies violations and a plan for corrective action is in place. The provisional certification will continue until corrections have been made and the Division is informed or until revoked.(2) Corrective action has not been completed by the completion date established in a corrective action plan. The provisional certification will continue until corrections have been made and the Division is informed or until revoked.(3) Renewal materials have not been submitted by the applicant per the Division's requested date, but were received by the Division prior to the expiration date of the current period of certification. The provisional certificate will remain in place until revoked or until replaced with full certification.(4) There is an exigent circumstance such as an extreme weather event including a hurricane, major flooding, fire or earthquake, that prohibits the provider from satisfying the requirements of the adult day care program. If an exigent circumstance prohibits an adult day care program from meeting the requirements for recertification, the Division of Aging and Adult Services may issue a provisional certification for up to 180 calendar days from the date of the exigent circumstance.(b) A provisional certificate shall not be effective for more than six months.(c) When a provisional certificate is issued, the program shall post a copy of the notice from the Division of Aging and Adult Services adjacent to the current certificate.
