I, Nelson A. Rockefeller, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and the Laws of the State of New York, do hereby direct by Executive Order that Executive Order Number 28, dated September 16, 1968, which designated the Social Development Planning Commission as the State's official long-range social development planning agency, be amended to read as follows:
I, Nelson A. Rockefeller, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby establish in the Executive Department an interdepartmental social development planning commission, to be known as the Social Development Planning Commission, to consist of the Commissioner of Social Services as chairman, and the Commissioners of Education, Health, Human Rights, Labor, Mental Hygiene, Local Government, Housing and Community Renewal, the Chancellor of the State University, the Director of the Division for Youth, and the Director of the Office for the Aging. The Director of the Division of the Budget shall serve as a non-voting member.
The Commission shall coordinate and review social development planning efforts among governmental and non-governmental agencies, organizations and groups concerned with services, facilities and manpower. "Social development planning" shall include planning for assistance to the disadvantaged, increased job opportunity, human rights, employee protection, and coordination of administration.
In exercising its powers, functions and duties, the Commission shall be responsible to the Governor and shall consult and work closely with the Social Development Planning Advisory Council.
A Social Development Planning Advisory Council is hereby established to consist of representatives of governmental and non-governmental organizations and groups to advise the Social Development Planning Commission in the exercise of its powers, functions and duties under this Order. The members of the Advisory Council shall be appointed by the Governor.
The Office of Planning Services shall provide all personal and other support services as may be necessary or desirable to assist the Social Development Planning Commission to fulfill the purposes of this Order.
The Office of Planning Services, acting for and on behalf of the Social Development Planning Commission, is hereby authorized to receive and disburse funds from the Federal Government granted for social development planning purposes.
Executive Order Number 28, dated September 16, 1968, which designated the Social Development Planning Commission as the State's official long-range social development planning agency, is hereby amended and superseded by this Executive Order effective April 1, 1971. On such date, all rights and obligations of the Social Development Planning Commission under any contract or agreement relating to functions, powers and duties transferred by this Order to the Office of Planning Services are hereby transferred and assigned to, devolved upon and assumed by the Office of Planning Services. With respect to the functions, powers, duties, rights and obligations so transferred and assumed the Office of Planning Services shall be deemed and held to constitute the continuation of the Social Development Planning Commission and not a different agency or authority. Any proceeding or other business or matter heretofore undertaken or commenced by or before such Commission may be conducted and completed by the Office of Planning Services in the same manner and under the same terms and conditions and with the same effect as if conducted and completed by such Commission.
Provision may be made, within appropriations available therefor and subject to the Civil Service Law, for the transfer to the Office of Planning Services of such officers and employees of the Social Development Planning Commission other than Commission members as the Director of the Office of Planning Services may deem necessary.
All appropriations or reappropriations together with any Federal funds advanced to the Social Development Planning Commission, to the extent of remaining unexpended or unencumbered balances thereof, whether allocated or unallocated and whether obligated or unobligated, shall be transferred to and made available for use by the Office of Planning Services for the same purposes for which originally appropriated or advanced.
