Section 3.7 - Special procedures for motorcycle licenses(a) A class M or MJ license may contain an appropriate restriction based upon the vehicle in which the road test was taken. Such a restriction permits the holder to operate only those types of vehicles specified in the limitation. (1) An applicant for a class M or MJ license must pass a written test and a road test conducted on a motorcycle consisting of a maneuver phase and a traffic phase. The applicant must supply a passenger car as well as a licensed driver to operate the same for the purpose of transporting the motor vehicle license examiner during the traffic phase of the road test. Failure to furnish such vehicle and driver shall result in refusal to give any portion of the road test to the applicant.(2) A class M or MJ learner permit does not permit the holder to carry a passenger, unless such passenger is the holder of a license which entitles him to operate that class of motorcycle, and such passenger is acting in the capacity of supervising driver to the permit holder, and the motorcycle is equipped with a passenger seat.(3) The holder of a class M or MJ learner permit may operate that class of motorcycle only while under the immediate or general supervision of a person who is at least 18 years of age, and who is the holder of a license which entitles him to operate the same class of motorcycle. General supervision shall mean control over and direction of the operator of a motorcycle within a one-quarter mile area from the point of such control and direction.(4) The holder of a class M or MJ learner permit for the purposes of taking the motorcycle road test may drive the motorcycle to and from the road test post under the general supervision of a supervising driver. A receipt will be issued upon completion of the road test to evidence the right of the holder to drive the motorcycle as a learner until the midnight following the test.(5) A person shall be eligible to secure a class M or MJ driver's license without passing a road test conducted on a motorcycle provided: (i) that he or she is the holder of a valid New York driver's license, and is a member of a police department having 25 or more motorcycle police and acceptable proof of graduation from an approved motorcycle training program conducted by the police department by which he or she is employed; or(ii) that he or she is the holder of a valid out-of-state license which specifically permits the operation of motorcycles in accordance with the provisions of Part 8 of this Title; or(iii) that he or she is the holder of a valid ''New York driver's license, and has successfully completed the 15-hour ''Motorcycle Rider Course: Riding and Street Skills'' developed by the Motorcycle Safety Foundation (MSF), or a compatible course approved by the Department.N.Y.
