Section 65.33 - Prehearing briefs(a) The Board or hearing officer may, when it appears necessary, require the parties to submit prehearing briefs that include any or all of the following: (1) statements of the principal contentions of the parties;(2) identification of evidence to be submitted at hearing and the purpose of the evidence;(3) names of witnesses and subjects of their testimony; and/or(4) discussion of the legal issues.(b) When prehearing briefs are requested, the Board or hearing officer will fix the time for submission of such briefs and any responses or replies, as well as give notice to the parties of the issues to be addressed. If oral argument is required, the Board or hearing officer will send notice to the parties of the time and place for oral argument.N.Y. Comp. Codes R. & Regs. Tit. 12 § 65.33
