Section 19:75-7.5 - Appeals(a) Any holder of a certificate, permit or medallion whose approval has been revoked, suspended or modified by the Authority may file a written appeal with the Executive Director or his or her designee. The appeal shall be filed within five business days after such holder of a certificate, permit or medallion knows or should have known of the facts giving rise to the appeal. Failure to file a timely appeal shall bar any further action.(b) The written appeal shall set forth in detail the facts upon which the appeal is based and shall define the issues and/or facts in dispute. In addition, the holder of a certificate, permit or medallion may request a hearing, which shall be conducted pursuant to the Administrative Procedure Act, N.J.S.A. 52:14B-1 et seq. and the Uniform Administrative Procedure Rules, N.J.A.C. 1:1, or an informal conference, pursuant to (f) below.(c) If the holder of a certificate, permit or medallion has filed an appeal but has not requested a hearing or an informal conference, the Executive Director or his or her designee shall carefully consider all available, relevant information and shall, within 10 business days, determine to confirm, modify or vacate the original finding or determination. The holder of a certificate, permit or medallion shall be notified in writing of the determination.(d) The decision rendered after a hearing conducted in accordance with the Administrative Procedure Act, or by the Executive Director or his or her designee pursuant to (c) above, shall be reviewed by the Authority's Board of Commissioners who shall adopt, review or modify the decision within 45 days.(e) The decision of the Board of Commissioners shall be final and conclusive.(f) An informal conference may be held before the Board of Commissioners, with or without representation on behalf of the owner/operator.
