In the event that a currently occupied space is contaminated, the occupying agency shall be responsible for the appropriate notifications, coordination with the Department of Environmental Protection (DEP), testing, reporting and abatement. The tenant agency is responsible for obtaining a Certification of Negative Declaration of Approval or a No Further Action Letter and Covenant Not to Sue from DEP.
