Every person acting as a secondary contractor in violation of this subchapter shall be subject to penalty and fine by the Department under the insurance laws of this state as an unauthorized insurer in accordance with N.J.S.A. 17:51-1 et seq., or 17B:33-1 et seq., as may be appropriate.
