Section 11:2-14.7 - Voting on the plan

(a) Voting on the plan shall be in accordance with N.J.S.A. 17:17C-5 under the supervision of the Department or its designee(s). At the conclusion of the policyholder meeting, the insurer shall verify and tabulate such votes separately from those received other than in person and shall execute and deliver to the Commissioner a certificate setting forth the number of valid ballots received, and broken down into the following categories:

1. Paper ballot received by mail;

2. Paper ballot cast at the policyholder meeting;

3. Votes cast by IVR;

4. Votes cast by internet; and

5. A new vote included as part of a revocation of a ballot pursuant to N.J.A.C. 11:2-14.6(g)2.

(b) The certificate shall specify the number of votes in favor of and the number opposed to the plan as required by N.J.S.A. 17:17C-4e and N.J.S.A. 17:17C-5.
