Section Ed 1123.19 - Extension of 45-Day Period(a) A hearing officer may grant extensions of time beyond the period set out in Ed 1123.18(e), except as to expedited hearings, for specific periods of time at the request of either party if: (1) The child's educational progress or well-being would not be jeopardized by the delay;(2) A party would not have adequate time to prepare and present the party's position at the hearing in accordance with the requirements of due process; and(3) The need for the delay is greater than any financial or other detrimental consequences likely to be suffered by a party in the event of delay.(b) A hearing shall not be continued by the hearing officer because of the hearing officer's schedule.N.H.
