Section Ed 1113.03 - Establishment of Education Programs for Children with Disabilities(a) A program for preschool children with disabilities may be home-based, school-based, or a combination of both. The preschool program shall consist of special education or special education and related services, the specific manner and duration of which shall be provided according to the preschool child's IEP.(b) An LEA shall: (1) Establish an approved program or programs for children with disabilities;(2) Enter into cooperative agreements with other LEAs to provide approved programs for children with disabilities; or(3) Pay tuition to such an approved program maintained by another LEA or by a private organization, as required by RSA 186-C:10.(c) Each program maintained by, or contracted through, a public agency shall provide that children with disabilities are educated with nondisabled children in accordance with the requirements of 34 CFR 300.114.(d) A program for children with disabilities shall provide those components of the child's approved IEP as required in 34 CFR 300.320.(e) Instruction shall be provided to implement the IEP of a child with a disability who is in a hospital or institution for medical treatment. In such cases, the LEA shall not be required to pay for medical services except to the extent that medical services are included in the definition of related services in Ed 1102.04(q).(f) The LEA shall designate the individuals responsible for supervision of children with disabilities. Personnel responsible for these activities shall include the superintendent of schools or the superintendent's representative, the building principal, and special supervisors.N.H. Admin.
