A producer, when making a recommendation of an annuity, shall act in the best interest of the consumer under the circumstances known at the time the recommendation is made, without placing the financial interest of the producer or insurer ahead of the interest of the consumer. A producer has acted in the best interest of the consumer if they have satisfied the obligations regarding care set forth in section 16, the obligations regarding disclosure set forth in section 17, the obligations regarding conflicts of interest set forth in section 18 and the obligations regarding documentation set forth in section 19.
