Section 640C.Sec. 16 - NEW
1. If the Board grants a petition pursuant to subsection 4 of section 15, the Board will issue a declaratory order or advisory opinion, as applicable. The Chair of the Board or other presiding officer shall assign one member of the Board to write the order or opinion. Not more than 30 days after being assigned to write the order or opinion, and after reviewing comments by all other members on the issue, researching the issue and seeking the assistance of legal counsel, if necessary, the member shall submit a draft to the Board. Upon completion of the draft, the assigned member shall submit the draft to the Board for approval at the next regularly scheduled meeting of the Board. To be issued as a final declaratory order or advisory opinion of the Board, the draft of the order or opinion must be approved by a majority of the members of the Board who are present at the meeting.
2. After the Board renders its declaratory order or advisory opinion, the Board will notify the petitioner.
