Section 639.754 - Refilling prescriptions: Restrictions; authorization by patient without specific request for particular refill1. When refilling a prescription, a pharmacy shall not select a drug from stock, place any drug in a container for dispensing or affix a label to a container for a refill of a prescription, unless: (a) Except as otherwise provided in subsection 2, the patient, the patient's prescribing practitioner, or the authorized agent of the patient or the patient's prescribing practitioner has specifically requested a refill of the prescription and the prescription has remaining authorized refills; or(b) The prescription does not have any remaining authorized refills and the patient's prescribing practitioner has authorized additional refills for the prescription.2. A patient may, in a written or electronic record maintained by the pharmacy, authorize the pharmacy to refill any future authorized refills, without a specific request for any particular refill, for the number of times authorized or for the period authorized without a request for a refill so long as the patient may rescind the authorization at any time by notifying the pharmacy.Nev.
