Section 618.Sec. 3.5 - NEW1. In establishing the penalty for a violation of this chapter or chapter 618 of NRS, the Division will consider the determining factors to be: (a) The gravity of the violation; and(b) Whether the violation is classified as serious or within a classification other than serious.2. In determining the amount of a penalty, the Division will consider the gravity of the violation as its primary consideration and use the gravity of the violation as the basis for calculating the base amount of the penalty for any violation that is classified as serious or in a classification other than serious.3. To determine the gravity of a violation, the Division will assess: (a) The severity of the injury or illness which could result from the alleged violation; and(b) The probability that an injury or illness could occur as a result of the alleged violation.Nev.
