Section 445A.67581 - Conduct of new process of environmental review after completion of prior environmental review for water project1. If the Division determines that an applicant has completed an environmental review for a water project:(a) Within 5 years before the date on which the applicant notifies the Division that the applicant is ready to proceed with the water project pursuant to the provisions of NAC 445A.6758; and(b) That substantially complies with the provisions of NAC 445A.6758 to 445A.67612, inclusive, the Division may not require the applicant to conduct a new process of environmental review pursuant to the provisions of NAC 445A.6758 to 445A.67612, inclusive.
2. If the Division does not require an applicant to conduct a new process of environmental review pursuant to the provisions of subsection 1, the Division shall conduct the procedures for public notice set forth in NAC 445A.67584, 445A.67589 and 445A.67612.Nev. Admin. Code § 445A.67581
