Section 435.430 - Appeals1. An applicant may appeal from: (a) A decision by the Division that he or she is ineligible for assistance pursuant to NAC 435.400 to 435.430, inclusive, and section 2; or(b) An award or denial of assistance to the applicant by the Division. If the applicant wishes to appeal the decision or award or denial of assistance, he or she must file a written appeal with the designated employee of the Division within 15 days after the applicant received notice of the decision.
2. The designated employee of the Division with whom an appeal is filed pursuant to subsection 1 may require documentary evidence to support the appeal. The designated employee shall complete his or her review of the appeal within 30 days after receiving the written appeal.3. An applicant may appeal a decision of the designated employee of the Division concerning an appeal filed pursuant to subsection 1 by filing a written appeal with the Administrator or a person designated by the Administrator. The appeal must be filed within 15 days after the applicant receives written notice of the decision. The decision of the Administrator or the person designated by him or her concerning an appeal filed pursuant to this section is a final decision for the purposes of judicial review.Nev. Admin.
