A local health officer may conduct an audit of medical exemptions granted pursuant to NRS 394.194 in the jurisdiction of the local health officer if:
1. The reported immunization rate of a private school falls below 95 percent;2. A private school fails to report immunization data annually pursuant to NRS 394.192;3. The rate of medical exemptions granted by a private school is higher than the average rate of medical exemptions granted by public schools in this State, as determined by the Division of Public and Behavioral Health of the Department of Health and Human Services or from data available from the National Immunization Surveys conducted by the Centers for Disease Control and Prevention, or if such a survey or organization ceases to exist, an equivalent federal source; or4. The local health officer determines such an audit is necessary to protect public health on a case-by-case basis.Nev. Admin. Code § 394.Sec. 9
