Section 442-5-023 - Rehearing023.01Motion by a Party. Any party to a proceeding heard by a panel of Commissioners may file a motion for rehearing with the full Commission for a rehearing of the proceeding within thirty days of the date that the Decision and Order was filed. No hearing shall be held on the motion. The Motion for Rehearing must be approved by a majority of the Commissioners holding office at the time the motion is filed. The filing of a motion for rehearing tolls the thirty-day appeal period provided by Neb. Rev. Stat. § 77-5019.023.02Commission. The Commission may issue an order for rehearing at any time prior to issuance of its order and decision. 023.03Rehearing of Appeal Heard by a Single Commissioner. Any party to a proceeding heard by a single commissioner may file a motion for rehearing within thirty days of the date a decision and order was issued, except for an order dismissing an appeal or petition for failure of the appellant or petitioner to appear at a hearing on the merits. The commission shall grant a rehearing on the merits before the commission. The filing of a motion for rehearing tolls the thirty-day appeal period provided by Neb. Rev. Stat. § 77-5019.442 Neb.
