Section 247-1-027 - APPEAL
027.01District Court of County of Arrest. Any person who feels himself or herself aggrieved because of such revocation after a hearing may appeal therefrom to the district court of the county where the alleged events occurred for which he or she was arrested. The appeal must be filed within 30 days after the service of the final decision by the agency.
027.02Administrative Procedure Act. Such appeal shall be made in accordance with the Administrative Procedure Act. The Department shall be a party of record for purposes of appeal to a district court.
027.03Stay Upon Appeal. Such appeal shall not suspend the order of revocation.
027.04Transcript. The Department will prepare the official record of the agency after notification that the Appellant served the Attorney General as provided in the manner provided for service of summons in Neb. Rev. Stat. § 25-510.02.
027.05Cost of Preparation of Official Record. The Department shall charge the petitioner with the reasonable direct cost or require the petitioner to pay the cost for preparing the official record for transmittal to the court.
