Section 163-3-007 - Wastes

Under the authority of and in compliance with section 37309, 37-1246 and 37-1268, R.R.S. 1993, the following regulations in regard to wastes rules are prescribed by Nebraska Game and Parks Commission and are effective following enactment by the Game and Parks Commission, approval by the Attorney General and Governor, and when five days have elapsed since filing with the Secretary of State.

007.01 In order to protect the safety and health of the boating and water-using public and to promote uniformity of laws, every vessel with an installed operable toilet must have an operable U.S. Coast Guard certified marine sanitation device (MSD) attached to the toilet. Such vessels under 65 feet in length must be equipped with one of the following MSD's:

Type I, Type II or Type III, such vessels over 65 feet = Type II or Type III as described by the code of Federal Regulations 33, Part 15 9, Subpart A, Definitions Q, R and S.

All of the above devices, which are equipped with a "Y-Valve" must be secured in the closed position while operating on Nebraska waters by the use of padlock, heavy tape, non-releasable wire-tie or the removal of the valve handle so the valve can't be used either accidentally or intentionally with the owner/operator's knowledge.; No wastes or container of such wastes shall be placed, left or discharged in or near any waters of this state.
