Rule 7-3-84.18 - Appeals Procedures for Career Technical Education Data Reporting1.INTRODUCTIONDistricts are encouraged to promote continuous improvement in academic achievement and technical skill attainment. State Board Policy Rule 84.18 outlines the state procedure for disputes that may arise between a local education agency and the Office of Career and Technical Education (OCTAE) in relation to student performance data as required by the Strengthening Career and Technical Education for the 21st Century Act (Perkins V). The policy provides a dispute resolution procedure for local school districts who aggrieve student performance data housed in the District Summary Reports received annually prior to state Perkins V reporting.
2.ADMINISTRATIVE PROCEDUREIf Districts are aggrieved with data provided by the OCTE related to Carl Perkins reporting, Districts shall utilize the following dispute resolution procedure:
A. Within ten (10) business days after receiving the data summary report, submit a letter to the State Career and Technical Education Director stating the issue and justification for the dispute along with a copy of the data summary report with the disputed numbers identified. The letter shall be submitted in writing, dated, and signed by the District CTE Director/Contact Person and District Superintendent and sent to the following address: Mississippi Department of Education

B. Within ten (10) business days after receiving the letter, the State Career and Technical Education Director shall review and respond in writing with his/her decision.C. If the District disagrees with the decision from the State Career and Technical Education Director, the District may, within five (5) business days, appeal to the Associate State Superintendent of Secondary Education. This request shall contain the original letter of request, the response from the State Career and Technical Education Director, a restatement of the issue(s) and a request for outcome.D. Within five (5) business days of receiving the appeal, the Associate State Superintendent shall review and respond in writing with his/her decision.E. If the district disagrees with the decision from the Associate State Superintendent, the District may, within five (5) business days, appeal to the State Chief Academic Officer. The request shall contain the original letter of request, the responses from the State Career and Technical Education Director and the Associate State Superintendent of Secondary Education, a restatement of the issue(s) and a request for outcome.F. Within five (5) business days of receiving the appeal, the State Chief Academic Officer shall review and respond in writing with his/her decision.
